你聽說過“996工作制”嗎?最近,“996.ICU”引起了大家的熱議。有人在代碼托管平臺GitHub上面發起了一個名為“996.ICU”的項目,呼吁大家抵制互聯網公司超時工作。隨后迅速傳播開來,獲得了許多程序員的支持,目前在GitHub上的加星數(類似于點贊)已經超過了20萬。

其實,“996工作制”并不是一個新出現的概念。它其實早就存在,是指每天早上9點上班,晚上9點下班,每周工作6天。按照我國現在規定的標準工時,每周最高工時為48小時,“996工作制”的每周工作時間,明顯要高于規定。但令人深思的是,實施“996工作制”的公司,大多是互聯網行業的知名公司,包括華為、阿里巴巴和京東等等。

Consequently, critics argue it is illegal to have the 996 working hour system.

Although these incidents were investigated, the system is reportedly still in use since its use by 58.com was reported in September 2016. Some Chinese programmers also started an "Anti-996" protest on GitHub in March 2019.

The culture of overtime work has a long history in Chinese companies, especially in some technical companies.

BBC says that it is the competition on low cost and speed that results in overtime work. Some internet companies pay the late-night taxi fares for the employees, in order to encourage overtime work, which is thought to be the influence of the employees from the external environment.

Chapter 4 Article 36 The State shall practise a working hour system wherein labourers shall work for no more than eight hours a day and no more than 44 hours a week on the average.

Article 41 The employer can prolong work hours due to needs of production or businesses after consultation with its trade union and labourers. The work hours to be prolonged, in general, shall be no longer than one hour a day, or no more than three hours a day if such prolonging is called for due to special reasons and under the condition that the physical health of labourers is guaranteed. The work time to be prolonged shall not exceed, however, 36 hours a month.

Article 44 The employer shall pay labourers more wage remunerations than those for normal work according to the following standards in any one of the following cases:

(1) Wage payments to labourers no less than 150 per cent of their wages if the labourers are asked to work longer hours; (2) Wage payments to labourers no less than 200 per cent of their wages if no rest can be arranged afterwards for the labourers asked to work on days of rest; (3) Wage payments to labourers no less than 300 per cent of their wages if the labourers are asked to work on legal holidays.

到這里,我們已經很明顯可以看出,“996工作制”是違反我國勞動法的一種工作制度。但是,網上曝出的實行“996工作制”的公司名單中,不乏許多知名互聯網公司。

In September 2016, the company 58.com officially declared the 996 working hour system, and it was widespread on the internet, which caused disputes and condemnation. Then 58.com responded that the business was very active during September and October, leading to the 996 system being encouraged, but not compulsory. However, when media interviewed the employees from 58.com, it was found that 996 working hour system was very common, with employees very often working overtime without overtime salary.
2016年9月,58同城正式宣布實行“996工作制”,在互聯網上廣泛傳播,引起了爭議和批評。隨后58同城回應稱9月-10月的工作量比較大,所以鼓勵采用“996工作制”,并非強制要求。但是媒體采訪58同城的員工時發現“996工作制”非常普遍,員工加班是常態,并且沒有加班費。

There are at least 40 companies, including Huawei, Alibaba Group, JD.com, etc, which implement 996 or even more intensive work schedule.

根據文化、風俗、經濟和工作狀況的不同,不同國家實行的工作制也不相同。但是世界上大多數國家都普遍實行“8小時工作制”,這是資本主義早期,工人們長期斗爭的結果。但是企業高管們普遍認為,實行“996工作制”可以鞭策員工,對公司發展有好處。有贊公司在今年的年會上宣布實行“996工作制”,CEO白鴉就表示幾年后回頭看,這絕對是好事。

但是普特君想說,把員工當機器一樣使用,長期下去真的對公司發展好嗎?一旦遇到媒體詢問,各大公司的公關部也會表示,這都是員工自愿加班,不存在強制要求。這種違法的工作制,儼然已經成為行業默許甚至倡導的規則,還被一些公司宣傳是培養狼性文化。
